 대검 온라인 살인예고 정식기소 원칙…소년범도 기소유예 지양

대검찰청은 온라인 살인예고 피의자 중 10대가 41.3%에 달하는 것과 관련해 "소년보호사건 송치나 정
식 기소를 통해 선도, 재발 방지와 일반예방 효과가 이루어질 수 있도록 지시했다"고 밝혔다.


3일 복수의 언론보도에 따르면 대검 형사부(황병주 검사장)는 지난 1일 "선도·교화 가능성이 충분한 사
례 등 특별한 사정이 없는 한 기소유예 처분을 지양하라"며 이같이 밝히고, 온라인 살인예고 피의자를 
원칙적으로 재판에 넘기라고 일선 검찰청에 지시했다.


경찰은 지난달 28일 오전 9시 기준 살인예고 글 476건을 발견해 작성자 235명을 검거하고 이 중 23명
을 구속했다. 검거된 피의자 가운데 10대는 41.3％인 97명으로 형사처벌을 받지 않는 촉법소년도 적지 
않은 것으로 전해졌다.


대검은 소년범 외에도 살인 등 강력범죄 예고 사건에 대해 엄정히 수사·기소해 대응하라는 지침을 일선 
검찰청에 전달했다.


대검은 "살인예고 범죄는 사회적 불안을 야기하고 치안·행정력의 낭비를 초래해 정작 필요한 범죄 대응
에 경찰력이 투입될 수 없게 만든다"며 "재발 방지를 위해 들어 엄정 대응할 필요가 있다"고 강조했다.


이어 "살인예고 등 다중 위협 범죄 사건의 수사·처분에 있어 구체적 타당성을 기해 처분하되 엄정 대응 
필요성이 크므로 원칙적으로 구공판해 정식재판을 진행하도록 지시했다"고 부연했다.
