 4대강 취소소송 원고패소 판결
 法 "4대강사업의 목적 정당하다"

국토해양부(장관 정종환)는 한강 살리기 사업과 관련, 작년 11월 25일 제기된 ‘한강 하천공사시행계획 취소소송’에 대해 3일 법원(서울행정법원 제6행정부)에서 기각판결을 선고했다고 밝혔다.
 

법원은 국가재정법, 하천법, 한국수자원공사법, 환경영향평가법, 문화재보호법 등 관련법령에 대한 법적 위반이나 절차상 하자가 없다고 봤다. 아울러, 홍수예방, 용수확보, 수질개선, 생태계에의 영향, 일자리창출, 사업성 등에 대해서도 4대강 사업이 충분한 정당성과 필요성을 가지고 추진된 것임을 판시했다.
 

재판부는 한강유역에 홍수예방이 필요하다며 동 사업으로 인해 홍수위가 낮아지는 등 홍수예방 효과가 있다고 보았고, 본 사업으로 인해 침수피해 가능성이 높아진다고 볼 수는 없다는 점을 언급했다.
 

용수확보에 대해서는 우리나라 강우특성 등을 고려할 때, 4대강 사업의 목적이 정당하고 목적달성을 위한 적절한 수단으로 보인다고 했다.
 

수질문제에 대해서는 수질모델링 결과에서 남한강 하류와 팔당댐의 수질이 다소 개선되는 것으로 보았으며, 생태계 문제의 경우도 생태습지 조성, 자연형어도 설치, 비닐하우스 철거 등을 고려할 때 생태계가 파괴된다고 단정할 수 없다고 보았다.
 

마지막으로 일자리 창출효과, 4대강 사업의 경제성 등에 대해서도 사업성이나 타당성이 없다고 단정할 수 없다고 밝혔다.
 
이번 판결은 4대강살리기 사업과 관련한 수계별(한강, 낙동강, 금강, 영산강) 취소소송 중 첫 판결로, 낙동강 살리기 사업 취소소송에 대한 판결선고는 10일(금) 있을 예정이고, 금강 및 영산강 살리기 사업에 대한 취소소송은 12월중 변론 종결을 거쳐 향후 선고가 내려질 전망이다.
