국가에 소송 낸 이적단체 패소판결

이적단체 남북공동선언실천연대(이하 실천연대) 관계자들이 ‘검찰의 수사결과 발표로 명예가 훼손되었다’는 취지로 국가를 상대로 낸 손해배상 청구소송에서 패소했다.
검찰은 지난 2008년 국가보안법 위반 혐의로 실천연대 관계자들을 기소하면서, 이들이 ‘간첩들과 같이 이름과 전화번호를 변용해 사용하면서 조직을 관리하고 북한정권을 찬양숭배 했다’는 내용의 수사결과 내용을 발표한 바 있다.
그러자 이들이 ‘수사결과를 허위·왜곡 발표해 명예를 훼손했다’며 국가에 약 9000만원 상당의 손해배상 소송을 제기했다는 것.
하지만 30일 서울중앙지법은 “실천연대가 북한의 활동을 찬양하는 등 자유민주주의 질서에 해악을 끼칠만한 활동을 한 점을 감안하면 검찰의 공표행위는 공익성이 인정된다”며, 원고패소 판결을 내렸다.
한편 실천연대는 지난 7월 대법원 전원합의체에서 이적단체로 규정됐다.
