 한나라당 김동성 ´애국가도 불온가요냐´
 국방부 불온서적 지정 조치에 비아냥

집권여당이자 보수정당인 한나라당 소속 국회의원이, 국방부가 불온서적 반입금지에 헌법소원을 낸 군법무관들을 파면조치한 것을 문제삼고 나섰다. 

김동선 의원(사진)은 20일 KBS 1라디오 와의 인터뷰에서, 군법무관들이 헌법소원을 낸 것은 “모든 국민에게 보장되어 있는 헌법상 권리”라며 “군인도 국민이기 때문에 당연히 그런 헌법소원 할 수 있는 것”이라고 말했다. 

이어 “헌법상 보장된 국민의 권리를 행사했다고 파면사유가 될 수는 없는 것”이라며 “이게 무슨 성실의무 위반이라고 보여지지도 않고 또 품위유지 의무 위반이라고 보기도 어려울 것 같고 또 어떤 정치적 중립에도 의무 위반이라고 보기도 어려울 것 같다”고 밝혔다. 

또 “불온하냐, 아니냐, 하는 그런 판단의 기준은 이적성이 명백한 경우에 한정되어야 되지 않느냐”며 “한총련에서 권장하는 도서라고 해가지고 불온서적으로 지정을 한 논리로 따지고 가다보면 한총련에서 애국가를 부르면 애국가도 불온가요”라고 주장했다.
