 공정위 전속고발권 폐지…부당거래 고발 늘어날 듯

앞으로 공정거래법 등 관련 법을 어겼을 경우 공정위 뿐 아니라 감사원과 조달청, 중기청도 고발할 수 있다.   

 
공정거래위원회는 공정위의 전속고발권 폐지를 골자로 하는 공정거래법 · 하도급법 · 대규모 유통업법 일부 개정 법률안이 지난 25일 국회 본회의에서 의결됐다. 

 
개정법률에 따르면 현재 검찰만 가진 고발요청 권한을 감사원 등 3개 기관에 확대 부여하고, 해당 기관으로부터 고발요청이 있는 경우 공정위가 의무적으로 고발해야 된다. 

 
다만, 공정거래법상 담합의 경우 자진신고를 통한 담합 적발 및 구조적 와해를 위해 담합 자진 신고자는 고발하지 않도록 예외로 인정된다. 

 
공정위는 이번 법 개정으로 공정위의 전속고발제는 사실상 폐지됐으며, 앞으로 공정거래 관련 법 위반 행위 고발이 늘어날 것으로 예상된다. 

 
공정위는 내년 초 법 시행(공포 후 6개월 후)에 앞서 고발요청 권한이 부여된 기관들과 구체적인 고발요청 기준, 절차 등의 협의를 진행할 계획이다.
