 경찰 “제주해군기지 공권력 법에 따른 것”
 “채증활동, 범죄예방과 진압위해 정당”

경찰은 23일 제주대학교 법학전문대학원 재학생과 졸업생 일부가 제주 해군기지 건설 현장에서의 경찰 공권력 행사가 불법적이라고 주장한 것에 대해 “법이 정한 절차에 따라 공권력을 행사했다”고 반박했다.

 
서귀포경찰서는 이날 경찰 채증이 불법적으로 이뤄지고 있다는 주장에 대해 “경찰법(제3조), 경찰관직무집행법(제2조), 형사소송법(제196조)를 보면 재물손괴, 업무방해, 경찰 폭행 등 불법행위가 지속적으로 이뤄지는 시위 현장에서는 범죄예방과 진압을 위해 정당한 채증활동을 할 수 있다고 명시돼 있다”며 이같이 말했다.

 
또 “체포 역시 형법상 명확한 범죄행위 및 집시법을 명백히 위반한 행위에 대해 인권과 안전을 지키며 진행하고 있다”며 “앞으로도 인권과 안전을 최우선으로 법에 따라 공권력을 행사할 것”이라고 밝혔다.

 
앞서 제주대 법학대학원 재학생과 졸업생들은 이날 오전 제주도의회에서 기자회견을 열고 “제주해군기지 건설 현장인 강정마을에서의 경찰 공권력 행사는 불법 소지가 크다”고 주장했다.

 
더불어 “증거수집의 경우 영장을 발부받아야 하는데도 무차별적으로 행해져 또 다른 충돌 원인이 되고 있다”며 “국민의 기본권을 침해하는 불법적인 공권력 행사는 있어서는 안 된다”고 말했다.
