地球人은 이해할 수 없는 화성인 판결
검찰의 조롱거리로 전락한 곽노현 벌금 선고

서울중앙지검 정점식 2차장은, 사퇴한 경쟁 후보에게 2억원의 뇌물을 준 곽노현 서울시 교육감에게 징역형은커녕 벌금 3000만 원을 선고한 판결에 대하여 "어느 누구도 믿지 않는 것을 재판부만 믿는다고 한 '화성인 판결'이라서 地球人인 나로서는 이해할 수가 없다"며 "재판부가 곽 교육감 측을 '단일화 피싱 사기단'으로 인정하면서도 사기 피해자인 朴 교수에게만 징역 3년을 선고했다"고 비판했다.
조선일보에 따르면, 정 차장은 "곽 교육감 본인도 법정이나 검찰 조사에서 경제적 지원을 약속했다고 인정했고, 협상 당사자들이 '당선되면 7억, 낙선해도 5억 제공'이라고 합의를 한 것"이라며 "재판부가 곽 교육감의 말장난 늪에 빠져 허우적거리는 판결을 내렸다"고도 했다.
판결이 조롱의 대상이 되면 法治도 조롱거리로 전락한다. 그 어떤 法理와 논리로도 이해할 수 없는 이번 판결을 이해하게 하는 키 워드는 이념이다. 재판부는 곽노현과 같은 이념의 소유자들이라고 추정할 수밖에 없다.
